Beach Break Occupational Therapy is committed to protecting private and confidential personal information in accordance with privacy laws. This policy outlines our policy and procedures on the handling the information that is collected from participants and their families. The Privacy Act 1988 and Health Records and Information Privacy Act 2002 ensures that your personal information is protected and that it is stored and used appropriately. As such, we are required to follow certain requirements in relation to the collection of information and the access we have to certain information.

1.     What type of information do we collect?

 We may request to collect and use the following types of information to ensure we provide you with appropriate health and safety services. 

 This could include, but is not limited to:  

-        Personal details e.g. contact, date of birth, emergency contact details 

-        Caregiver name and contact details

-        Information regarding your health/disability e.g. diagnosis, treating health/medical professionals 

-        Details about use of funding e.g. NDIS 

We only gather information that is necessary for us to meet our potential for supporting your and your needs. 

2.     Why do we need to collect, hold and disclose your information? 

We collect, hold, use and disclose personal information in line with legislated requirements to retain records. This ensures we can:

-       Provide you with appropriate services and develop a support plan

-       Maintain a record of our services to you

-       To communicate with third parties (e.g. NDIS) in relation to our service that we have provided for you

-       To collect payments

-       Referrals or accessing other services

 

3.     How is consent obtained? 

We keep your records confidential and only disclose information to others if you have provided us consent to do so. You will be asked to complete a consent form where you can detail who information can be released to which is signed by the participant or caregiver where appropriate. Consent can be withdrawn at any time by contacting us. 

4.     How do we collect and store personal information?

Information is gathered either through forms that you complete or by Beach Break Occupational Therapy recording the information that is provided to us. This could be through observations or reported during sessions, emails, phone calls, and information from third parties. Your OT records and personal information will be kept on Beach Break Occupational Therapy’s client management system.  

 

5.     Who do we get information from and who is it provided to? 

This could include, but is not limited to:  

-        Medical professionals- e.g. doctor/specialist or allied health

-        NDIS supports e.g. LAC, support coordinator, plan manager 

-        Your nominated advocate 

-        Your school and teachers 

 

6.     How can I review or gain access my personal information? 

You can contact us if you wish to have access to your information as long as there is no valid exemption under the privacy legislation. No other parties may access your file unless they have been nominated. If you wish to change or update your nominee details, please contact us. 

 

7.     What should I do if I feel my privacy has been not been respected?
